These Terms of Sale (“Terms”) govern the purchase and sale of products through www.beaumontjewelrycollective.com (the “Site”). By placing an order through the Site, you agree to be bound by these Terms.
You must be at least 18 years of age and legally capable of entering into a binding contract to place an order. Products are sold for personal use only and not for resale or export.
Your order constitutes an offer to purchase. All orders are subject to acceptance by Beaumont Jewelry Collective (“BJC,” “we,” “our,” or “us”).
We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to orders that:
An order confirmation or payment authorization does not constitute acceptance of your order. Acceptance occurs only when we issue a shipping confirmation email.
All prices are listed in U.S. dollars and are subject to change without notice.
You agree to provide current, complete, and accurate billing and payment information. By submitting payment information, you represent that you are authorized to use the designated payment method.
We reserve the right to correct pricing errors and cancel orders arising from such errors.

We reserve the right to refuse shipment, intercept shipment, or require additional identity verification if fraud is suspected, even after an order confirmation has been issued.
Initiating an unjustified chargeback or payment dispute may constitute a breach of these Terms. We reserve the right to provide transaction records, delivery confirmation, signature confirmation, and other documentation to payment processors in response to disputes.
All orders are shipped fully insured. An adult signature is required upon delivery. Shipping and delivery dates are estimates only.
Title and risk of loss pass to you upon confirmed delivery at the shipping address provided in your order, as evidenced by carrier tracking records and signature confirmation (if applicable).
If a package is returned due to refusal, failed delivery attempts, or incorrect address provided by the customer, additional shipping fees may apply.
Claims for items lost or damaged in transit must be reported within seven (7) days of the carrier’s confirmed delivery date.
For international shipments, the customer is solely responsible for:
BJC is not responsible for delays, seizures, or additional charges imposed by customs authorities.
Risk of loss for international shipments transfers upon confirmed delivery.
If an international shipment is refused, abandoned, or returned due to unpaid duties or failure to comply with local import laws, you remain responsible for all original shipping charges, return shipping charges, and any additional carrier or customs fees incurred.

We reserve sole discretion, acting reasonably and in good faith, to determine whether returned items meet eligibility standards based on their condition at the time of return compared to their condition at shipment.
Items that have been worn, scratched, resized, altered, chipped, damaged, or otherwise modified are not eligible for refund unless due to a verified structural defect.
Customers are responsible for return shipping costs and bear the risk of loss during return shipment. We strongly recommend fully insured, trackable shipping.
Refunds will be processed to the original payment method after inspection and approval.
Custom pieces, resized items, and items marked final sale are not eligible for return.
Returns requested after the seven (7) business-day window may, at our discretion, qualify for store credit if the item is in excellent condition.

Repair and resizing requests are reviewed on a case-by-case basis.
Unless due to a structural defect, customers are responsible for shipping costs associated with repairs or resizing.
Not all pieces can be resized due to design limitations.
EXCEPT AS EXPRESSLY STATED IN WRITING BY BJC, ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
Variations in color, tone, or natural characteristics of gemstones and materials are inherent and not considered defects.
TO THE FULLEST EXTENT PERMITTED BY LAW, BJC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATING TO YOUR PURCHASE OR USE OF ANY PRODUCT, REGARDLESS OF THE LEGAL THEORY ASSERTED AND EVEN IF BJC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability for any claim arising out of or relating to the purchase of products shall not exceed the amount paid for the product giving rise to the claim.
Nothing in these Terms limits liability that cannot be excluded under applicable law.
We are not liable for delays or failure to perform due to events beyond our reasonable control, including acts of Nature, carrier delays, natural disasters, governmental actions, labor disputes, or supply chain disruptions.

You and Beaumont Jewelry Collective (“BJC”) agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase of products through the Site, or the relationship between you and BJC (whether in contract, tort, statute, fraud, misrepresentation, or any other legal theory) shall be resolved exclusively through final and binding arbitration, rather than in court, except as otherwise provided below.
This arbitration agreement is governed by the Federal Arbitration Act (“FAA”). The substantive laws of the State of Oregon shall govern any dispute, without regard to conflict of law principles.
Before initiating arbitration, the party asserting a claim must provide written notice of the dispute to the other party and allow thirty (30) days for informal resolution.
The arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect. The AAA Rules are available at www.adr.org or by calling the AAA at 1-800-778-7879.
The arbitration shall be conducted by a single neutral arbitrator. The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement.

The arbitrator may award any relief that would be available in a court of competent jurisdiction. Judgment on the arbitration award may be entered in any court having jurisdiction.
Payment of filing, administration, and arbitrator fees will be governed by the AAA Consumer Arbitration Rules. Each party shall bear its own attorneys’ fees unless otherwise required by applicable law or awarded by the arbitrator.
YOU AND BJC AGREE THAT ALL CLAIMS SHALL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
The arbitrator may not consolidate the claims of more than one person and may not otherwise preside over any form of representative or class proceeding.
Notwithstanding the foregoing, either party may bring an individual claim in small claims court if the claim qualifies and remains in that court.
You may opt out of this arbitration agreement by providing written notice to Beaumont Jewelry Collective within thirty (30) days of your purchase. The notice must include your name, order number, mailing address, and a clear statement that you wish to opt out of arbitration. Notices must be sent to:

If any portion of this arbitration provision is found unenforceable, the remaining portions shall remain in full force and effect. If the class action waiver is found unenforceable, the arbitration agreement shall be void. This arbitration provision survives termination of these Terms.

These Terms, together with our Privacy Policy and Website Terms of Use, constitute the entire agreement between you and BJC regarding purchases through the Site.
